Terms of Service
The rules for using Nephia during its public beta — Queries, Sources, mentions, channels, the product API, the MCP server and the AI features.

These Terms of Service ("Terms") govern your use of Nephia’s website, dashboard, product API, MCP server, documentation and related services (the "Services"). By creating an account, signing in or calling the API, you agree to them. If you do not agree, do not use the Services.
These Terms incorporate our Privacy Policy, our Refund & Cancellation Policy and, where you instruct us as a processor, our Data Processing Agreement.
1. Definitions
- "Nephia", "we", "us": the Nephia service, operated by an individual based in France (see the Legal notice).
- "You": the individual or organisation using the Services.
- "Account": the container for your Queries, channels, API keys and usage, created on first sign-in.
- "Source": a third-party platform or site whose public content we read — for example X, Reddit, YouTube or Vinted.
- "Query": one thing you watch — a brand, a name, a product, a topic — defined by search terms, Sources, a refresh interval and, optionally, AI instructions and rules.
- "Mention": a public post, comment, video, article, listing or AI answer that matched a Query, together with the labels we add to it.
- "Channel": where a Query delivers — Slack, Discord, email or an HTTP endpoint you configure.
- "Product API" and "MCP server": the programmatic and agent-facing interfaces to your Account, documented at docs.nephia.cc.
- "AI features": grouping, sentiment, sorting, summaries, reports, agent steps, semantic search and any feature that uses a language model on Mentions.
- "Credits": the unit in which AI work and history are metered against an Account’s allowance.
- "API key": a credential issued for the Product API and the MCP server.
2. Eligibility and accounts
2.1 Eligibility
You must be at least 18 and able to enter a binding contract. If you use the Services for an organisation, you confirm you may bind it to these Terms.
2.2 Sign-up
Signing in (Google or a sign-in link) creates an Account on first use. One mailbox, one Account: addresses with a +tag, disposable addresses and mailboxes that already have an Account are refused, and no more than a few Accounts may be created from one network address per day. You are responsible for:
- Keeping API keys and sign-in access confidential
- All activity under your Account and API keys
- Telling us promptly of unauthorised use
- Providing accurate account information
2.3 Account status
We may restrict, suspend or close an Account for a breach of these Terms, abuse, legal risk or operational necessity. A suspended Account loses sign-in, its API keys stop working and its Queries pause. A closed Account’s data is deleted as the Privacy Policy describes; closure is not the same as an erasure request, which you can make separately.
3. Public beta
- Free, and as is. No plan is sold and no payment is taken. The Services are provided without any availability, accuracy or support commitment. Section 13 applies in full.
- Beta limits. Every Account receives the limits published on the pricing page and 20,000 Credits per thirty-day cycle. We may change the limits with notice on the pricing page.
- Credits have no monetary value. They cannot be bought, sold, transferred or refunded, and expire with their cycle.
- It will change, and it will end. We may change or stop any feature, and may end the beta, with 30 days’ notice by email. When it ends, you choose a plan — free or paid, on the terms published then — or your Account is closed after that notice, with the export window of section 9 before deletion. Nobody is charged without choosing a plan and entering a payment method themselves.
- Feedback. If you send us feedback, we may use it without obligation to you.
4. Licence, API and MCP access
4.1 Licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your own internal purposes — monitoring what is said about the names, brands, products and topics you have a legitimate interest in.
4.2 API keys, Product API and MCP
API keys are Account-scoped and must not be shared, sold or exposed. Everything done with a key — including by an AI agent you connect through the MCP server — is done by you: metering, quotas and enforcement attach to your Account, and you are responsible for what your agents do with the Mentions they read (see section 7).
4.3 Limits
Query counts, terms per search, refresh intervals and request rates vary by plan and are published on the pricing page and in the documentation. Exceeding a limit returns an error or pauses a Query; it never silently truncates. We may adjust limits to protect the platform, and tell you when we do.
5. Acceptable use
5.1 How Nephia operates
Nephia retrieves publicly reachable Source content. We do not sign into end-user accounts on your behalf, access private messages, or retrieve paywalled or auth-walled content as part of the Services.
5.2 Permitted uses
- Monitoring mentions of your brand, products, name, competitors or market
- Market research, competitive analysis and business intelligence
- Social listening and sentiment analysis on public posts
- Price and listing monitoring on public marketplaces
- Academic or scientific research
- Feeding Mentions to your own tools and agents through the API and the MCP server
5.3 Prohibited uses
You may not use the Services to:
- Break the law, a regulation or a third party’s rights
- Harass, stalk, threaten, dox, discriminate against or surveil individuals
- Build or sell dossiers on private individuals, surveillance tools or re-identification systems — including linking a public handle to a real identity
- Collect sensitive categories of personal data (health, political opinion, religion, sexual orientation, and the like) about individuals
- Train, fine-tune or evaluate a machine-learning model on Mentions, or assemble a dataset from them for resale
- Resell or republish Mentions in bulk, or build a competing monitoring or Source-access service on top of Nephia
- Spam, phish or send unsolicited commercial messages to authors of Mentions
- Overload, disrupt, reverse-engineer or compromise Nephia or a Source
- Circumvent metering, quotas, authentication, sign-up rules or Account restrictions
- Use the Services from, or for, a sanctioned jurisdiction where that is prohibited
6. Mentions belong to their authors
A Mention is something a person wrote in public. Nephia gives you a way to find it and read it; it gives you no rights in it. You acknowledge that:
- The text, images and metadata of a Mention remain the property of their author and subject to the terms of the Source they were posted on. We grant you no licence to reproduce or republish them.
- You may use Mentions internally: read them, label them, quote them to colleagues, answer them on the platform where they live. Publishing a Mention elsewhere is your decision, made under the quotation and fair-use rules that apply to you, and at your own risk.
- Where Mentions contain personal data, you are the controller of what you do with them after they reach you. Nephia stores them for the windows stated in the Privacy Policy and processes them on your instructions under the DPA. You must have a lawful basis for your use and answer the data-subject requests that concern the copies you hold.
- When an author asks us to remove a Mention, we remove it from every Query that holds it, including yours, and tell you nothing about the requester.
- Sources change, degrade and block. We adapt when we can and say so when we cannot; we do not guarantee that any Source stays available or complete.
7. AI features
7.1 Outputs are estimates
Sentiment, groups, sorting buckets, summaries, reports, agent-step results and semantic matches are produced by language models. They are automated, statistical readings of text written by strangers, provided as decision support. They are not statements of fact about an author, a product or you, and you must not present them as such or act on them in a way that harms a person without checking the underlying Mention.
7.2 Mentions are untrusted input
Mentions are written by people you do not know, some of whom may write text designed to manipulate a language model — including instructions aimed at your agents. When you pass Mentions to your own tools, agents or models, through the MCP server, agent steps, the Product API or an export, you must treat them as data and never as instructions: keep the permissions of any automated system reading them narrow, and keep a human in the loop for actions that cannot be undone. We do the same on our side, and we cannot vouch for text we did not write.
7.3 No training
Nephia does not train, fine-tune or evaluate any AI model on Mentions, on your instructions or on your account data, and does not allow its AI provider to. Requests are routed only to model hosts that neither train on nor retain the content, as the Privacy Policy describes. You give the same undertaking for the Mentions you obtain through the Services (section 5.3).
8. Credits and plans
A plan sells four things: how many Queries you may run, how many terms a search may carry, how fresh a Query is (its minimum refresh interval) and a request rate for the Product API. Credits meter the two things that cost us per use — AI work and history — against the allowance a plan grants each cycle. Costs per operation are published in the documentation; a charged operation that cannot be paid for is refused, never silently truncated.
During the public beta no plan is sold (section 3). Billing terms — renewal, changes, cancellation, the merchant of record, taxes, chargebacks — will be added to these Terms and to the Refund & Cancellation Policy before the first sale, with 30 days’ notice.
9. Export and switching providers
Your Queries and their Mentions are yours to take at any time, without charge, in open formats: CSV from the dashboard (5,000 rows per file, AI labels included as columns) and JSON through the Product API, which also returns your Query and channel configuration. When these Terms end for any reason — you leave, we close your Account other than for breach, or the beta ends — you keep read access for 30 days before deletion. Nothing in these Terms prevents you from moving to another provider, and we charge no switching fee. This section is our commitment under Chapter VI of Regulation (EU) 2023/2854 (the Data Act).
10. Availability and changes to the Services
We aim for high availability and publish live status at status.nephia.cc, but we do not guarantee uninterrupted Services and commit to no service level during the beta. Maintenance, Source-side blocks, provider outages and events beyond our control may cause downtime or degraded results. We may modify features and endpoints; we announce breaking changes to the Product API and the MCP server in the documentation ahead of time, and material removals by email with 30 days’ notice.
11. Intellectual property
Nephia and its licensors retain all rights in the Services, software, documentation and branding. You retain rights in your own instructions, notes, applications and the data you lawfully hold. Mentions are covered by section 6. Sources are trademarks of their owners, who neither sponsor nor endorse Nephia.
12. Confidentiality
Non-public information about the Services — undocumented internals, security details, the named list of Source-access providers we may give you under NDA — is confidential. You will not disclose it except as required by law or with our written consent. A Mention is not confidential because it passed through Nephia; your Queries and instructions are, and we treat them so.
13. Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MENTIONS ARE COMPLETE, ACCURATE OR CURRENT, THAT AI OUTPUTS ARE CORRECT, OR THAT ANY SOURCE PERMITS AUTOMATED READING UNDER ITS OWN TERMS.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEPHIA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS.
BECAUSE THE SERVICES ARE FREE DURING THE PUBLIC BETA, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THEM IS LIMITED TO ONE HUNDRED EUROS (EUR 100). THE CAP THAT WILL APPLY TO PAID PLANS WILL BE PUBLISHED WITH THE BILLING TERMS. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, DEATH OR PERSONAL INJURY, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER THE LAW THAT APPLIES TO YOU — INCLUDING, IF YOU ARE A CONSUMER, THE MANDATORY PROTECTIONS OF YOUR COUNTRY OF RESIDENCE.
15. Indemnification
If you use the Services for a business, you will defend, indemnify and hold harmless Nephia and its operator from claims, damages and reasonable legal costs arising from: (a) your use of the Services or of Mentions; (b) your breach of these Terms or of the law; (c) your infringement of a third party’s rights; or (d) your processing of personal data obtained through the Services.
16. Term and termination
These Terms apply while you use the Services. You may stop at any time and close your Account by email. We may suspend or close an Account for a breach of these Terms or a risk to the platform, and may end the Services as section 3 describes. On closure, the export window of section 9 applies unless the closure is for breach of section 5. Provisions that by nature survive — sections 6, 7.3, 11, 12, 13, 14, 15 and 18 — survive.
17. Changes to these Terms
We may update these Terms. Changes are posted on this page and dated. A material change is announced by email to account holders 30 days before it takes effect; if you do not accept it, you may close your Account before that date, at no cost, with the export window of section 9. Using the Services after the effective date is acceptance.
18. Governing law and disputes
These Terms are governed by French law. If you use the Services for a business, the courts of France have exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory rules of the country where you live and may bring a claim before its courts. Before either, write to us: most disputes are settled by email.
If a provision is unenforceable, the rest remains in effect. Our not enforcing a right is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor operator or company, and will tell you when we do.
